The offense was charged to have been committed in the city of Roswell in Chaves County on June 15, 1950. The jury having returned a verdict of guilty after being duly instructed on the law of the case, it was within its province to believe the facts leading up to and in connection with commission of the offense charged were as they shall now be related.
